Live Broadcast Services Disclaimer & Limitation of Liability

1. Nature of Live Broadcast Services

Live broadcasting and real-time streaming services inherently involve complex technical systems and third-party infrastructure beyond our direct control. These systems may include, but are not limited to:

  • Public and private internet networks

  • Bonded cellular transmission systems

  • Internet Service Providers (ISPs)

  • Mobile network carriers

  • Power utilities and venue electrical systems

  • Content Delivery Networks (CDNs)

  • Streaming platforms (e.g., YouTube, Vimeo, Facebook Live)

  • Cloud-based hosting services

  • Venue-installed AV systems

While Evermore utilises professional-grade equipment and fully bonded transmission systems designed to maximise redundancy and reliability, uninterrupted or error-free performance cannot be guaranteed.

Bonded transmission technology aggregates multiple network connections to enhance stability; however, it does not eliminate the risk of disruption, latency, signal degradation, desynchronisation, partial loss, or complete transmission failure.

2. Acknowledgement of Inherent Risk

By engaging our services, the Client expressly acknowledges that:

  • Live production and broadcasting carry inherent technical risks.

  • Performance depends in part on third-party infrastructure beyond our control.

  • Temporary interruptions, quality fluctuations, buffering, resolution drops, audio interference, or brief outages may occur despite reasonable professional precautions.

Minor interruptions or technical fluctuations shall not constitute a material breach of contract.

3. No Guarantee of Uninterrupted Service

To the fullest extent permitted by law, Evermore:

  • Disclaims all warranties of uninterrupted, continuous, or error-free live transmission.

  • Does not guarantee platform uptime, network stability, or third-party system reliability.

  • Shall not be liable for failures caused by internet service providers, streaming platforms, venue infrastructure, power supply disruptions, or force majeure events.

4. Backup & Recording Procedures

We implement professional redundancy procedures including:

  • Fully bonded cellular transmission systems

  • Multi-network aggregation

  • Local on-site recording backup (where technically feasible)

  • Pre-event equipment testing

  • Battery and power redundancy systems

However, in rare circumstances involving simultaneous system failures, corrupted media, hardware malfunction, or unforeseen technical events, recording or streaming may be partially or entirely unavailable.

The Client acknowledges that no technical system can be made entirely fail-safe.

5. Limitation of Liability

In the event of a total broadcast failure directly attributable to our negligence, our liability shall be strictly limited to: The total fees paid by the Client for the specific livestream service.

Under no circumstances shall Evermore be liable for:

  • Emotional distress

  • Loss of opportunity

  • Reputational impact

  • Indirect or consequential damages

  • Third-party claims

This limitation applies to the fullest extent permitted by applicable law.

Filming, Drones, Public Liability & Insurance

Evermore maintains appropriate Public Liability Insurance and Professional Indemnity Insurance for the provision of filming and live broadcast services.

While all reasonable care is taken when operating equipment within venues, the Client acknowledges that:

  • We operate with professional filming equipment including tripods, cables, lighting, and transmission units.

  • The venue remains responsible for providing safe access, power, and operational space.

  • The Client is responsible for ensuring that venue permissions for filming and livestreaming have been obtained where required.

Evermore shall not be liable for venue-related restrictions, removal of filming rights, or interference caused by third parties.

Drone Operations - Regulations & Weather

Drone services are subject to applicable aviation laws and regulations in force at the time of the event. We will not operate a drone where doing so would breach Civil Aviation Authority (CAA) rules, airspace restrictions, venue limitations, or safety requirements.

Drone flights are also strictly weather-dependent. We reserve the right to suspend, delay, or cancel drone operations where weather or environmental conditions are deemed unsafe, including high winds, rain, storms, low visibility, or other adverse conditions.

Where drone services cannot be provided due to regulatory or weather restrictions, this shall not constitute a breach of contract, and liability shall be limited to the drone service fee paid (if applicable).
